RetaliationRetaliation The Supreme Court has further defined retaliation under the retaliation clause in violation of 42 U.S. 2000e-3(a) which makes it unlawful to discriminate against an employee who has opposed an unlawful employment practice or made a charge, testified, assisted or participated in an investigation, proceeding or hearing of discrimination. No. 06-1595 (January 26, 2009). The Court held that the retaliation clause covers employees who speak out in an internal investigation and not only where the employee has initiated and filed a complaint. |
