OFCCP PUBLISHES UPDATED SEX DISCRIMINATION FINAL RULE
On June 14, 2016, the OFCCP published the Updated Sex Discrimination Final Rule. This will become effective on August 15, 2016. Contractors are already subject to many of these provisions under Title VII of the Civil Rights Act of 1964, however, there are many new and expanded requirements. Among other things, this new rule makes clear that sex discrimination includes discrimination because of an employee’s and applicant’s gender identity.
AAP BENCHMARKS ANNOUNCED IN 2016
Effective 2016 The Benchmark for Veterans has been updated to 6.9% and the Utilization Goals for Disabled remains at 7%. These Benchmarks and Goals will be used in the upcoming Affirmative Action Plans. Information on other onsite compliance requirements is available at the following links:

Once you’ve selected Benchmark Outsourcing Group to prepare your AAP, you can expect to receive professionally prepared reports that comply with OFCCP requirements consisting of the following:
Affirmative Action Program for Minorities and Women prepared in compliance with Federal regulations.
Affirmative Action Program for the Disabled Veterans and Veterans of the Vietnam Era – Section 503/38 U.S.C. 4212 AAP(s) prepared according to the requirements of 41 CFR Parts 60-741 and 60-250.
Affirmative Action data reports as follows:
- Workforce Analysis
- Job Group Analysis
- Availability Analysis for each job group with a determination of minority and female availability
- Utilization Analysis for each job group with the comparison of incumbency to availability
- Adverse Impact data on your company’s employment activity including flow of applicants, hires, promotions and terminations by job group
All narratives will be written in accordance with current Federal regulations. Benchmark Outsourcing Group will work with the your company’s Human Resources staff or designated person and our lawyers to ensure that the content in the AAP narrative and reports is comprehensive and accurate.
Your company will receive simple spreadsheets for ease in downloading your data and contact information. Once this data is received, Benchmark will analyze your data, develop your plans and return your completed Affirmative Action Plans within 30 days. There are provisions for faster turnaround if this is necessary.
Benchmark will subsequently discuss your plan results with you to help you understand any problem areas where underutilization of females or minorities may exist and will suggest ways to comply with Executive Order 11246 and to develop goals to correct deficiencies.
